Terms of use of the Site

By consulting the pages of this Site, the User is subject to the following conditions of use, it being specified that they may change and that it is advisable to consult them at each visit:

1. Information site

The ATEM site (hereafter "the Site") is an information site.

The information contained on this Site is as accurate as possible and the Site is periodically updated but may contain inaccuracies, omissions or gaps. If you notice a gap, an error or what seems to be a dysfunction, please report it to the address " contact@atem.fr ". ATEM cannot, in any case, be held responsible for direct or indirect prejudices which would result from decisions and/or actions of the Users following their access and their consultation of the ATEM Website, the latter being only responsible for their use of the Website.

2. Accessibility to the Site

The website of ATEM is in principle accessible to the users 24 hours a day, 7 days a week, except in case of interruption, programmed or not, for the needs of its maintenance or in case of force majeure. In case of impossibility to access the service, ATEM commits itself to do its best to restore the access to the service. Being only subject to an obligation of means, ATEM cannot be held responsible for any damage, whatever its nature, resulting from an unavailability of the Website. Moreover, the User is only responsible for the means he uses to access the Website. The User also declares that he/she is aware of the nature of the Internet, accepts its characteristics and limits (in particular the limits in terms of security) and ensures its protection against any intrusion or contamination by viruses or other technical incidents.

3. Intellectual Property

The website of ATEM, its arborescence, the elements and data which appear on it such as texts, images, logos, photographs, graphics, icons, trademarks, drawings, illustrations, software are likely to be protected by the intellectual property.  

Any reproduction, representation, publication, broadcasting, modification, adaptation, extraction, total or partial, of the ATEM website or of any of its elements is forbidden, except with a written and preliminary authorization of ATEM and/or of the concerned rights holders. Otherwise, it will be considered as a counterfeit and liable to prosecution in accordance with the applicable provisions of the Intellectual Property Code.

Protection of personal data and cookies

1. Validity and update of the policy of personal data protection and cookies

This Privacy Policy was posted on February 1, 2022.

It applies to any processing of personal data on the Website and to any interaction between a User, a Customer, a Prospect, a Supplier, a Partner, a Provider, a Candidate, a Trainee and ATEM from this date.

Any changes will be posted on this Site as they occur and/or communicated directly to the individuals concerned, as appropriate.

Users are invited to consult this section regularly. 

2. ATEM, company responsible for the processing of personal data

ATEM Law Firm, a limited liability company (hereinafter referred to as "ATEM"), registered in the Paris Trade and Companies Register, under the number 450 771 902, whose head office is located at 22 avenue de Friedland, 75008 PARIS, publishes a website at www.atem.fr (hereinafter referred to as "the Website"), which can be consulted on computers, tablets and smartphones.

ATEM is the person in charge of the processing of personal data carried out on this Website. However, other data processors can also process personal data of the Users of the Website, under the conditions and under the reserves exposed hereafter.

In particular, this includes the Google Analytics tool, if you agree to this. Please refer to the section "Cookies and Other Tracers" below on this point (see section 11)

Moreover, ATEM is the person in charge of the processing of personal data carried out within the framework of the services it offers and the activities it carries out. Thus, ATEM can be led to process personal data of its Customers, Prospects, Partners, Providers, Suppliers, Candidates and Trainees.

However, ATEM can be led to subcontract to third parties the care to ensure services on its behalf allowing them to have access to some of your personal data, only if it is necessary. These are the accounting firm (Cabinet Messin) and the IT services company (Société AGTEK). These third parties commit themselves towards ATEM to treat the personal data to which they would have access within the framework of their services in the respect of the regulations in force.

3. General commitment of ATEM as personal data controller

ATEM undertakes to respect all the legal and regulatory provisions applicable to it relating to the protection of personal data and in particular the provisions of the European General Data Protection Regulation (EU 2016-679) and those of the amended Data Protection Act n°78-17 of 6 January 1978.

ATEM collects the personal data entrusted to it by the Users, Prospects, Clients, Partners, Providers, Suppliers, Candidates and Trainees in a fair and transparent way and processes these data in a legitimate and proportionate way.

4. Acceptance of the personal data protection policy by Users, Prospects, Clients, Partners, Providers, Suppliers, Candidates and Trainees.

By filling in the contact form on this Site, the Users acknowledge and accept the processing of some of their personal data by ATEM in accordance with the provisions of this Privacy Policy and with those of Google (for Google Analytics) if they agree to it.

Users are also informed that by using the services of an access provider or a search engine to access the Site, they are also subject to the personal data protection policies of the latter.

Prospects, Customers, Partners, Providers, Suppliers, Candidates and Trainees who communicate personal data by contacting ATEM also acknowledge and accept the processing of some of their personal data by ATEM in accordance with the provisions of this Privacy Policy.

5. Purposes of the processing of personal data

The purpose of the processing of the personal data of the users of the Website is to answer to the requests of the Users who contact ATEM by e-mail or by phone or by filling in the contact form proposed on the Website. Provided that the Users have expressly consented to these mailings by ticking the appropriate box when creating their account or later, the collected information can also be used to send newsletters to the Users to inform them about the news of the Firm, if necessary.

Processing of personal data of Prospects: These are prospects who have contacted the firm by phone, e-mail or in the "Contact" section of the Site or, more generally, who have wished to leave us their details. Their personal data will be used to respond to their requests, send them our greetings, if necessary information that could be useful to them.

The purpose of the processing of personal data of the Customers is to process the files entrusted to us, to manage the exchanges as well as the invoicing and the payment of our services, to send them information of a general or particular nature which may be of interest to them.

The purpose of processing personal data of Partners, Service Providers and Suppliers is to process our orders, manage exchanges with them and pay their invoices.

The purpose of the Processing of Applicants' personal data is to process applications, examine the CVs submitted, respond to applicants and organize relations with the selected applicants.

The purpose of the Processing of Trainees' personal data is to process information relating to trainees and the assignments entrusted to them during their presence at the Firm.

6. Personal data processed

As a reminder, personal data refers to any information relating to a natural person and allowing that person to be identified directly or indirectly.

ATEM only processes the data that are freely communicated to it by the person who is authorized to do so.

ATEM only processes personal data that are adequate, relevant and limited to what is necessary for the purposes for which they are processed in the framework of its communication and activities. Thus, for example, ATEM will never ask for personal data considered as "sensitive", i.e. relating to racial or ethnic origins, political, philosophical or religious opinions.

The personal data collected, processed, stored and archived by ATEM are listed below:

Name, first name, position, e-mail address, postal address, fixed telephone number (direct line), mobile telephone number and any other information transmitted by the Site User, the Prospect, the Client, the Supplier, the Partner, the Provider, the Candidate, the Trainee at his or her initiative or by legal or legitimate necessity.

Concerning the Users of the Site, it will be, in addition, the contents of the message transmitted on the contact form of the Site;

Other information may be transmitted to us during their navigation on the Site for Users who accept cookies. In this regard, please refer to the section "Cookies and Other Tracers" below.

In addition, the intermediaries, access providers, search engines and social networks through which the User accesses the Site may collect information about the User, in particular relating to his geographical location, his terminals (computer, cell phone or tablet), his browsing and his preferences. It is the User's responsibility to inform himself/herself about the conditions of processing of his/her data by these third parties.

Concerning the Prospects, it will be, in addition, the content of the message transmitted by telephone or on the voice mail of ATEM or any other personal information communicated to ATEM by any other means.

Concerning the clients, it will be, moreover, the elements and documents transmitted relating to the files entrusted to ATEM as well as the information allowing to exchange and to address our notes of fees and to follow their payment.

Concerning the Partners, Providers, Suppliers, it will be, moreover, the elements and documents allowing to exchange and to proceed to the edition, to the follow-up of the orders and to the payment of the invoices.

Concerning the Candidates, it will be, in addition, the resumes, letters of motivation, messages and information exchanged.

Concerning the trainees, it will be, in addition, the details contained in the training agreements, the elements relating to the activity of the trainee and the payment of his training allowances, the certificates of end of training.

7. Duration of storage of processed personal data

ATEM keeps the personal data of the Users, Customers, Prospects, Partners, Providers, Suppliers, Candidates and Trainees for the periods necessary to achieve the objectives pursued, i.e. for the following periods, unless the persons concerned exercise their right of deletion and withdrawal before the end of these periods:

  • Browsing data on the Site: 6 months
  • Data resulting from a contact of the User with ATEM (telephone contact or contact by electronic message via the Website): during the time necessary to manage the request of the User and then during a period of 3 years following the last contact of the User with ATEM unless the User becomes a customer of ATEM. In this case, as for the Partners, Providers and Suppliers, the data of the Customers are kept for a period expiring 5 years after the end of the contractual relation. However, the elements of invoicing and payment of the fees are kept for 10 years to meet the legal obligations.
  • Candidate data: data is kept for 2 years if the application is not followed up
  • Trainee data: data is kept for 5 years after the end of the training period.

 

Personal Data are then deleted. However, it can be temporarily archived in an intermediate archive in order to comply with the legal obligations of ATEM or to enable it to defend itself, if necessary.

8. Recipients of the personal data processed

The personal data are exclusively intended for ATEM. ATEM does not commercialize in any way the personal data of the Users, Clients, Partners, Providers, Suppliers, Candidates and Trainees.

However, this information can be transmitted to the service providers of ATEM (IT service provider, accounting firm). This transmission concerns the necessary information (contact details and addresses) for the management of the Users' request and/or for the processing of their files if they become ATEM's Clients or for the accounting or IT management of ATEM's relations with the Clients, Partners, Providers, Suppliers, Candidates and Trainees.

ATEM strictly requires the service providers to use the personal data of the Users only for the missions they are entrusted with, to manage the services it asks them to provide, on its documented instruction and in compliance with the legislation and regulations in force.

Personal data may also be communicated to a sworn third party in the event of a judicial or administrative requisition.

No personal data is transmitted by ATEM to the editors of social networks platforms and marketing tools such as Google. However, the Users are aware that the configuration of their terminals (computers, cell phones or tablets) is likely to allow the above-mentioned third parties to collect and exploit data concerning them, in particular via third party cookies if they accept them. Thus, these third parties may carry out their own processing of Users' personal data, in particular when Users search the Site in search engines. These possible collections are carried out, if necessary, under the responsibility of the third parties involved.

The Users fearing a use of their personal data without their knowledge are free to refuse to consult the Website, ATEM does not have any technical means to prevent such a collection.

9. User rights

Users have rights regarding their personal data.


In accordance with the modified law n° 78-17 of January 6, 1978, each Participant has the following rights on his Personal Data processed by ATEM:

  • right of access, right of opposition,
  • right of rectification,
  • right of withdrawal and deletion,
  • right to restrict processing,
  • right to the portability of personal data concerning him,
  • the right to set out instructions for the use of his or her personal data after his or her death.

 

These rights can be exercised by the Users, proving their identity, by writing to the following postal address ATEM, 22 avenue de Friedland, 75008 Paris or at the following e-mail address: contact@atem.fr.

ATEM reserves the right to verify the identity of the person concerned wishing to exercise his rights and to ask him, for this purpose, any element of proof such as a valid identity document.

ATEM will try to answer within 7 working days following the request, provided that it has previously been able to check the identity of the applicant.

10. Data retention - Security measures

The data of the Users, Customers, Partners, Providers, Suppliers, Candidates and Trainees are stored in the databases of ATEM and, if necessary, of its IT service providers acting on its behalf within the framework of the design and the management of the Website, on servers located in the European Union or in countries ensuring an adequate level of protection


ATEM, responsible for the processing, and its service providers, subcontractors, commit themselves to process these data in a lawful, fair and transparent way and to manage them with an appropriate level of security thanks to technical and organizational measures in conformity with the rules of the art in order to protect at best the confidentiality, the integrity and the availability of these data.

During the consultation of the Website, one or several cookies are likely to be automatically installed on the computer, the cell phone, the tablet of the User through his navigation software.
